Agreement to Terms

These Terms of Service ("Terms") govern your use of the Folliq mobile application ("the App"), owned and operated by Becca Foust ("we," "our," or "us"). By downloading, installing, or using Folliq, you agree to be bound by these Terms. If you do not agree, do not use the App.

Description of Service

Folliq is an AI-powered hair and scalp analysis application that provides observational, educational guidance based on photos submitted by users. Folliq also provides professional client management tools for licensed cosmetologists and trichologists.

Important Medical Disclaimer

Eligibility

• You must be at least 13 years of age to use Folliq
• If you are between 13 and 18 years of age, you must have parental or guardian consent
• By using the App you represent that you meet these eligibility requirements

User Accounts

You are responsible for maintaining the confidentiality of your account information and for all activity that occurs under your account. You agree to notify us immediately at folliqcare@gmail.com if you suspect unauthorized use of your account.

Acceptable Use

You agree to use Folliq only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit photos of individuals without their knowledge and consent
• Use the App to attempt to diagnose or treat medical conditions in yourself or others
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Use the App in any way that could damage, disable, or impair its functionality
• Submit false, misleading, or fraudulent information
• Use the App for any commercial purpose not expressly permitted by these Terms

Professional User Responsibilities

If you use Folliq as a licensed cosmetologist, trichologist, or other beauty professional to manage client information, you agree to:

• Obtain explicit informed consent from each client before entering their personal information or submitting their photos through the App
• Inform clients that their photos are processed by AI systems for analysis
• Comply with all applicable professional licensing requirements and regulations in your jurisdiction
• Comply with applicable privacy laws governing client records in your profession and jurisdiction
• Not enter protected health information as defined by HIPAA into the App

Intellectual Property

The Folliq name, logo, brand identity, app design, and all original content within the App are owned by Becca Foust and are protected by copyright, trademark, and other intellectual property laws.

You may not use the Folliq name, logo, or brand assets without prior written permission.

You retain ownership of photos and content you submit to the App. By submitting photos for analysis, you grant us a limited license to process those photos solely for the purpose of generating analysis results.

Subscription and Payments

Free Tier
The free tier of Folliq includes three lifetime scans. No payment information is required for free tier use.

Consumer Tier
The consumer paid tier provides unlimited personal scans for a one-time purchase fee. Purchase is final and non-refundable except as required by applicable law or App Store refund policies.

Pro Tier
The Pro subscription provides access to professional client management features at a monthly subscription rate. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your App Store account settings.

Price Changes
We reserve the right to change subscription pricing with reasonable advance notice to existing subscribers.

Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, BECCA FOUST AND FOLLIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Reliance on any analysis result generated by the App
• Decisions made based on App analysis results
• Loss of data
• Personal injury or health outcomes

Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Becca Foust, Folliq, and their representatives from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

Termination

We reserve the right to suspend or terminate your access to Folliq at any time for violation of these Terms. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Texas.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date and notify users through the App. Your continued use of Folliq after changes are posted constitutes your acceptance of the updated Terms.
